Terms and conditions

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY VISITING OR PROCESSING AN ORDER WITH US OR USING OTHER PARTS OF THE SERVICE, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MAY NOT USE ANY PART OF THE SERVICE. THIS IS A LEGAL AGREEMENT BETWEEN YOU AND PIPLY.

Overview

The Piply website, marketing materials, apps, foods and delivery service (piply.ie) and all pages attached to and including this domain name that make up the “service”. “You”, “your” and “customer” refers to the person using or interacting with the Piply service. This agreement exists exclusively between Piply and you as the customer and does not extend to other parties on behalf of whom you as a customer engaged with Piply.

We own or have a licence for all the intellectual property rights of our web presence and services. Such works are protected by copyright. You may not copy, reproduce, republish, download, broadcast, transmit, make available to the public, or use any content on our site for commercial purposes.

We are the owner of or the licensee of all intellectual property rights in our Site and our Service, and in the material published on it (excluding your Contributions). Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use any content on our site in any way except for your own personal, non-commercial use.

If you do not accept these terms and conditions in their entirety, do not use our service. The use of our service is confirmation of your agreement to these terms and conditions.

Piply limited (“we” or “us” or “Piply”), is registered in Ireland, with a main place of operation at 46a Harrington Street, Dublin, 8, Ireland or at such other premises as may be determined by Piply. Piply is a trading name for Foodemon Limited, the company registration number is 579575.

Accessing and use of the Service may be subject to third party terms and conditions. Costs, including, without limitation, the terms of service and data, SMS, MMS, and other fees of your mobile network operator, internet provider are the sole responsibility of the customer.

The Service

Piply provides a web service for people to order food which is prepared by Piply at one of our kitchens, then delivered to your designated delivery address.

Account

To access some features of the service, including placing an order, you must create an account. When you create an account, you will be required to provide us with some information about yourself (such as your name, email address or other contact information, as well as your credit card number, phone number and delivery address). Your email address will be used to send you product and service updates. These include, but are not limited to: receipts, follow up surveys, product updates, change of terms etc.

You must have a credit or debit card associated with your account in order to use the service. The last card used on your account will be stored, you must have authorisation to use and associate the card with your Piply account. Your credit card information is actually stored with our payment provider Stripe which is PCI compliant.

You agree that the information you provide to us is accurate and that you will keep it accurate and up-to-date at all times. When creating an account, will create a password. You are solely responsible for ensuring this is a strong password. It should not be the same password you use for other sites. It should be at least 8 characters, containing at least one special character and one number. Maintaining the confidentiality of your account and password is also your sole responsibility.

You agree to accept responsibility for all activities that occur under your account. If you have reason to believe that your account is no longer secure, then you must immediately notify us at [email protected] You should never provide sensitive information in email communications. You agree that Piply can use your personal information to send you marketing material and request feedback on the service. This includes your email address, phone number and postal address. You may unsubscribe at any time by contacting [email protected]

Removing a card

Please contact [email protected] to remove cards on your account. Never share your password or credit card information in email communications with us, this is an unsecured method of communicating and we accept no responsibility for any damages resulting from stolen data.

Delivery Area

Piply is currently a pilot service, operating in the Rathmines area. A delivery area map is published on our homepage. Please note that we may not be able to deliver to some places, even to places within our delivery zone. Deliverability is unfortunately dependent on weather, staff availability and other reasons. We reserve the right to cancel or reject orders for any reason. In this event, you will be refunded.

Delivery Protocol

Once an order is placed, you are required to be fully contactable via the phone number provided. Failure to be contactable by phone may impact on our ability to satisfy your order or to arrange delivery of same. Furthermore, all reasonable steps must be taken by you as regards facilitating the receipt of the Piply food delivery. Where a delivery is attempted and no party on behalf of the customer facilitates same, you will remain liable for the full costs of the service. Piply will make efforts to contact you for further information or to arrange delivery should there be difficulty in providing the food delivery (due to clarification regarding address location or obtaining access to the delivery premises) – failure of you to facilitate same will result in the withdrawal of our service, without liability. For clarity, the charges associated with your order under such circumstances will still be payable by the customer.

Delivery Times

We endeavour to have all orders delivered within a time limit of 90 minutes of the time that they order has been placed. We will update our website to estimate how long your order will take, based on our experience delivering to date – this is a general indication/estimate and is not a commitment to delivery within that suggested timeframe., If an order is placed during an extremely busy period or is delayed for some other reason, this could take significantly longer than 90 minutes. You take this risk when placing an order and is not grounds for a ‘not as described’ or other type of refund.

Cancelling an order

Once an order is placed, our kitchen and delivery team start working on it. Due the nature of this instant service, you usually cannot cancel your order. For clarification, once an order is placed, you are not entitled to a refund. If you need to cancel your order, please contact us by phone as this is the fastest way to get in touch with the kitchen and we can review your cancellation on a case by case basis, to determine if it has been processed already.

Allergens

We provide absolutely no guarantees around allergens in our foods. We prepare a variety of different meals in our kitchens and you should assume that all our meals may contain any of the allergens that exist in the natural world, for example, but not limited to: gluten, crustaceans egg, dairy, fish and all sealife, peanuts, nuts, beans, seeds etc.

If something is described as containing being ‘free’ for example ‘gluten free’, it means we have chosen ingredients that do not contain gluten to create the dish, but as described, there still may be traces in the food. Similarly, if something is described as ‘vegan friendly’ there still may be traces of animal products. These are a couple of examples, but it applies to all descriptions used on our menus and marketing materials.

Should you have any food allergies, we request that you contact us by telephone or by email in advance of ordering, to discuss your requirements with us. Please note that we are not able to amend dishes for specific requirements.

Competitions and Discounts

Competitions for free samples or other prizes have no cash value. In the event that weather, supply or other conditions prevent Piply from providing you with prizes or samples, we will make best efforts to make new arrangements. If not claimed within 7 days, unless otherwise stated, you lose the prize. Piply is not responsible for any losses you could suffer from entering or claiming a prize. Failure for Piply to deliver samples or prizes does not grant you rights to anything else or a replacement prize. Your data, such as email address, and other information collected with cookies and pixels can be used with third parties for advertising and business analysis purposes. We may change the conditions of our competitions so it is up to you to ensure you check in here regularly.

Coupons require a minimum spend of €14.00 unless otherwise stated.

Free dinners promos – By opting in, you agree to receive direct marketing emails from Piply. This will overwrite any previous unsubscribe requests. Winners will receive a voucher code for the value of one free main dish, with the condition that they must order within a specified time (e.g. in the next hour). This voucher will expire after the time frame described and once expired cannot be revived. The prize has no cash value. Please note, you must order online in order to use the code. One per person. One per household. You will need to pay for any other items you add to the order. You will still have to pay delivery charges, surcharges and any other costs associated with your order. You must live within our delivery zone. You must claim on 19th September or 20th September 2016. Runner-up prizes (e.g. one free starter) may be distributed also under the same terms with different dates as detailed in the winning email.

We will send an email at least 5 minutes before your voucher is due to become active. We cannot guarantee deliverability of emails.

 

Eating Better Campaign (October 2016) Advert in Rathmines Village with coupon code: minimum food spend must be €12.00 in order to apply discount. First order only. Online orders only. One per household. Abuse of coupon could result in the discount being revoked and essentially ruin it for everyone else.

Coupons can generally only be used for first time orders. Minimum spend may be required and may change from time to time without notice. Coupons can be revoked at any time and marketing materials should be used as a guideline only.

Friends of Piply

We may give you the opportunity to send vouchers to your friends. There is no guarantee that your entry will be selected. No cash value. Managements decision is final. This is a competition and winners will be selected randomly. If you enter a friends email address or other contact details you provide us with permission to send an email, sms or other direct communication to them on your behalf.

if you are the recipient of a voucher like this, there may be a minimum spend and the voucher may only work for new users, with a different delivery address to your friend. Non transferable and will only work with the email address that was nominated by your friend.

 

Other free dinner promos

From time to time we may offer customers a free dinner. This will cover the cost of the cheapest main course in your order. Strictly one per person and per household. Minimum order service charges and delivery charges still apply. During busy periods we may have to temporarily make the offer unavailable. These offers are limited and will be made available on a first come, first served basis.

Marketing Materials

We do our best to prepare beautiful images of the food which we are very proud of. Please note that the product you receive may vary significantly compared to the imagery used on our menu’s and advertisement materials. This is not to mislead you, however we present it beautifully in a studio setting so you can appreciate the product in its full glory. We also change our menu regularly based on customer feedback, ingredient availability, chef’s random creativity and a bunch of other reasons. Taking this into consideration, you agree that due to the nature of this very seasonal product, you cannot use the imagery as grounds for a ‘not as described’ or other type of refund. This is a risk you accept.

The service is described as healthy or healthier in our marketing materials. This is used in reference to comparable takeaway services that often provide convenient, but less healthy meal options. For example, deep fried foods or sauces rich in sugars and/or saturated fats. Such statements should be understood in this light and in no way constitute medical advice. Desserts, sweet snacks and other items should be eaten in moderation.

You should consult a suitable medical professional if you have any dietary queries to understand if our food is suitable for your specific requirements.

Ingredients

We switch out ingredients frequently depending on availability, customer feedback and chef’s random creativity. Our menu and marketing material may not reflect such on-the-fly updates – we reserve the right to change the preparation of any of the dishes listed on our menu. You cannot use the fact we switch out ingredients as grounds for a ‘not as described’ or other type of refund. This is a risk you accept.

Privacy

Your private information is retained for the purpose of providing you with the Piply service. If you no longer wish to use the service, you can close your account by contacting [email protected].

We store basic account information like your name, address and phone number on our servers or rented servers. Like all digital services, they have vulnerabilities and there may be some people who want to find ways to access your data. We take steps to try prevent such hacking but in the event our services are hacked we do not take responsibility for any damages or costs associated with such a breach. This is a risk you accept.

In order to provide the delivery service we print or distribute your details with our driver network, which may be outsourced. We take steps to ensure our drivers and delivery partners understand they must protect your data. You accept your information is shared in this manner and any misuse of said data is not our responsibility.

Third Party Analytics and Cookies

Piply uses third party analytics tools, mixpanel and google analytics. These services process your personal information and behaviours to help us provide a better service. We also use Google Adwords and Facebook conversion scripts to help understand and improve our advertising methods. Please refer to each of their specific privacy policies, which you also agree to by visiting / using the Piply services. Please note, we may introduce other third party tools from time to time and you agree this is acceptable. We also use cookies to provide and improve our service, for example to recognise if you are already a customer and display the relevant screens. We also use cookies and your data from time to time to advertise with third party tools. Examples include, but are not limited to Google and Facebook.

Free food Referral Scheme

When you complete an order, sometimes we will provide you with a unique promo code that you can share with your friends. This has no cash value. This can be cancelled at any time and has no guarantee. Strictly one per person, enforced by only allowing one per household, credit card and account. Other rules to ensure the scheme is used only once per household, or person or credit card may also be introduced without notice.

Complaints and Refunds

If you feel the service was not satisfactory and what you experienced fell outside of these terms and conditions, please contact us through the ‘Contact Us’ page on our website or by email to [email protected]. We will review every issue on a case by case basis.

Liability

Piply is not liable for any damages for delays for non-performance or if the service is unavailable. Piply is also not liable for any damages that may be incurred by you during your interaction with our service. For example, an interaction might be when you meet the delivery person on the street. We may consult with professionals such as dieticians and nutritionists from time to time, and relay content on our blog, menu or marketing materials. This does not constitute medical advice. Piply is not liable for any damages related to how you interpret any information presented by us. We recommend you consult with a suitable professional if you have any dietary or health queries.

Enforceability

If any provision of this agreement is found to be unenforceable or illegal, the rest of the provisions shall remain. The laws of the Republic of Ireland will govern this agreement. These terms will change regularly and you agree to stay informed by checking them frequently.
